1. Service Description

Durante is an AI operating system built on Claude Code. It provides persistent memory, structured execution workflows, and skill packs for AI-assisted development. The open-source version is licensed under the MIT License. The Studio platform provides cloud features including team management, billing, and a media gateway.

2. Account Requirements

• You must be at least 18 years old to use our services
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must have a valid Claude Code subscription from Anthropic to use Durante

3. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the security assessment or investigation skill packs against targets without proper authorization
• Redistribute modified versions of Durante under the Durante name without permission
• Use our media gateway to generate content that violates applicable laws or third-party AI provider terms
• Exceed your subscription's credit allocation or attempt to circumvent spending limits

4. Open Source License

The Durante codebase is released under the MIT License. You may use, modify, and distribute the code in accordance with the MIT License terms. The "Durante" name and brand assets are trademarks of Durante Technologies and are not covered by the MIT License.

5. Paid Services

5.1 Subscriptions

Paid subscriptions are billed through Stripe on a monthly or annual basis. Prices are listed in BRL (Brazilian Real) and are subject to change with 30 days' notice.

5.2 Credits and Media Gateway

Studio subscriptions include credits for the media gateway (AI image generation, voice synthesis, video production, and other AI services). Credits are consumed per-request based on the provider and model used. Unused credits do not roll over between billing periods.

5.3 Refunds

We offer refunds on a case-by-case basis within 14 days of purchase. Credits that have been consumed are non-refundable. Contact support@durante.tech for refund requests.

6. Intellectual Property

Content you create using Durante belongs to you. We do not claim ownership over any code, documents, images, or other outputs generated through your use of Durante. Content generated through third-party AI providers is subject to those providers' respective terms regarding output ownership.

7. Data and Privacy

Durante runs locally on your machine. We do not access, collect, or store your local data including code, MemPalace memory, knowledge graphs, or conversation history. Our data practices are described in our Privacy Policy.

8. Disclaimers

Durante is provided "as is" without warranty of any kind. We do not guarantee that AI-generated outputs will be accurate, complete, or suitable for any particular purpose. You are responsible for reviewing and validating all AI-generated content before use in production environments.

Security assessment and penetration testing skill packs are provided for authorized testing only. You are solely responsible for obtaining proper authorization before using these tools.

9. Limitation of Liability

To the maximum extent permitted by law, Durante Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of data, revenue, or business opportunities.

10. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use paid features ends immediately. The open-source codebase remains available under the MIT License regardless of account status.

11. Governing Law

These Terms are governed by the laws of Brazil. Any disputes shall be resolved in the courts of Sao Paulo, Brazil.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Continued use of our services after changes constitutes acceptance of the new Terms.
